Is a Fake Doctor's Note Illegal? How Employers Catch Fakes, Including AI-Made Notes

A fake doctor's note takes a few minutes to make. Free templates, editable PDFs and AI chatbots will all produce something that looks official. The trouble starts when someone at work picks up the phone, looks up the doctor, or scans the code on the page. Here is what the law says, how fakes get caught, and what a real note carries that a fake one can't.

The short answer: yes, a fake doctor's note can be a crime. State forgery laws cover making a false document, changing a real one, and handing either one to someone you mean to deceive. People have been criminally charged over a single forged sick note. Employers are also allowed to check notes, and checking one takes minutes.

Is a fake doctor's note illegal?

Forgery is the legal name for it. The wording differs from state to state, but the idea is the same everywhere. It is a crime to make or change a document so it appears to come from someone who never wrote it, when you plan to use it to deceive another person. Using the fake counts, not just making it. New York and Texas show how the laws read.

Other states have their own versions, and prosecutors do bring these cases. Three that made the news:

  • Indiana, 2019. A Postal Service plant manager asked the agency's inspector general to confirm a note that excused an employee from work for a week. The clinic named on it said nobody there had issued it. The employee admitted making it on her computer and was charged with counterfeiting (ABC57).
  • Illinois, 2021. A state transportation supervisor accused of writing fake doctor's notes to excuse himself from work was indicted in DuPage County on five counts of forgery and five counts of wire fraud (Fox 32 Chicago).
  • New York, 2026. In Saranac Lake, a coworker noticed inconsistencies in an employee's medical notes. Investigators found the letterhead and signatures didn't match real documents from the local medical center, and he was charged with third-degree forgery and second-degree criminal impersonation (CNY Central).

Separate from any criminal case, a forged note puts the job itself at risk, because it is falsified paperwork handed to an employer.

How fake doctor's notes get caught

Employers are allowed to check. HHS, which enforces the federal health privacy rule, says your employer can ask you for a doctor's note when it needs the information for sick leave. The EEOC says an employer may ask for a doctor's note to justify sick leave as long as it asks the same of every employee. For FMLA paperwork, the Labor Department lets HR, a leave administrator or a manager (never your direct supervisor) contact the health care provider to authenticate it.

Most checks take a few minutes. These are the things that give a fake away:

  • The office on the letterhead never saw you. Urgent care, ER or family practice, it doesn't matter. One call to the office named on the note is often all it takes. That is how the Indiana case unraveled.
  • The doctor's name and NPI don't match. Practicing physicians have a National Provider Identifier, a 10-digit number anyone can look up in the federal NPI Registry. A made-up doctor, a missing NPI, or an NPI that belongs to someone else stands out fast.
  • The letterhead or signature looks off. Logos, fonts, addresses and signatures that don't match the clinic's real paperwork are what gave away the New York case.
  • The dates don't add up. A note signed before the illness started, dates in a slightly different font, or a visit on a day the clinic was closed.
  • There is nothing to verify. Notes from verifiable services carry a document ID or a QR code that leads to a record. A note with no way to check it gets a harder look, not a pass.

Can ChatGPT or an AI tool make a doctor's note?

An AI chatbot can write something that reads like a doctor's note in seconds. Looking real was never the hard part. Researchers showed in 2024 that ChatGPT can generate fake medical reports, in a paper in the journal Diagnosis titled "For any disease a human can imagine, ChatGPT can generate a fake report."

What no AI tool can produce is the part an employer checks: a licensed physician who actually evaluated you, an NPI that belongs to the person who signed, and an office that confirms the note when asked. So an AI-made note fails the same phone call a printed template fails. Legally it is treated the same way too, because forgery laws look at who a document claims to come from, not at the software that made it.

The AI companies don't allow it either. OpenAI's usage policies bar using its services to manipulate or deceive people, including any use for deceit, fraud or impersonation.

The same goes for fake doctor's note generators and editable templates. Downloading a blank template is not the crime. Filling one in and handing it to an employer or a school as a real note is what forgery laws describe.

Can you edit a doctor's note?

No. Changing a date or a name on a real note is forgery too, because the laws cover altering a document, not just inventing one. New York's law says "falsely makes, completes or alters." Texas covers making a writing look like it was signed "at a time or place ... other than was in fact the case." A real note with an edited date is a forged note.

How hard is it to get a fake doctor's note?

Making one is easy. Getting away with one is not, because a fake only has to fail one check, and notes stay in personnel files. A check can come months later, during a review, an FMLA request or an investigation. The Illinois case began with a tip to state police investigators.

Can HR find out a fake doctor's note?
